To hold accountable those involved or complicit in state capture corruption, all those who were involved or complicit must face criminal prosecution.

This week, the Special Tribunal ordered Systems Applications and Products (SAP) to pay R500 million to the Special Investigating Unit (SIU) within seven days, following a settlement reached between the German software multinational corporation and the SIU. This settlement arose from two corrupt contracts totalling R1.1 billion. Eskom awarded SAP the two contracts during corporate state capture at the public entity. The Special Tribunal declared the two contracts invalid and set them aside.

The news of SAP having to repay is indeed welcomed. However, it is imperative that the entire amount is repaid, rather than just a portion of it. Furthermore, SAP chief executive, directors, and other executives involved in securing the corrupt contracts, along with Eskom executives and officials who awarded the contracts to the private company, must face criminal prosecution. Every person who was involved, including at board levels and above, must face prosecution.

To effectively hold accountable those involved or complicit in state capture crimes, the National Prosecuting Authority must avoid selectivity in its approach. This is crucial for South Africa to dismantle state capture networks and ensure justice is served.
