The South African Communist Party (SACP) welcomes the Supreme Court of Appeal (SCA) order granting Justice and Correctional Services Minister Advocate Michael Masutha leave to appeal against parole for Janusz Walus, the cold blooded murderer of our former General Secretary Chris Hani.
In March, North Gauteng High Court Judge Nicolene Janse van Nieuwenhuizen? ordered that Walus must be released from prison on parole within fourteen days. The order was dissapointing, in particular its serious legal difficulties and loopholes. On this basis the SACP held that there were reasonable prospects for successfully appealling against the judgement. But Judge Nicolene Janse van Nieuwenhuizen ?disagreed and denied the Minister, who was joined by the SACP and the Hani family, leave to appeal.
As the SACP we are happy that the SCA, contrary to Judge Nicolene Janse van Nieuwenhuizen, granted the leave to appeal.? The SCA order means that Walus, who remains an unrepentant, unremorseful and unrehabilitated murderer, will remain behind bars until the appeal process is concluded. The SACP will continue pushing for justice to serve its full course!
