SACP Statement on Janusz Walus`s application to be released on parole without legal processes exhausted

The South African Communist Party (SACP) made its representation today in the North Gauteng High Court opposing Janusz Walus`s application to be released from prison on parole based on "exceptional circumstances". The SACP showed that no exceptional circumstances exist for Walus to be released without all due legal processes including appeal proceedings relating to his parole concluded. The SACP also showed that the unrepentant murderer will not suffer any irreparable harm.

Walus`s Psychological Report states that he has a healthy psychiatric record but that his hatred for communist leadership has not been cured. Walus has therefore not been rehabilitated. He is still holding on to the reasons why he murdered Chris Hani. He remains a danger to society in defiance of our country`s Constitution.

The Constitution guarantees everyone - not excluding communists - their political rights, including the right to freedom of association. Hate crimes, such as murdering people because of their political belief, are strictly prohibited in terms of the rule of law.

Walus, the unrehabilitated murderer, has not showed remorse. He does not have any regard to the enormity of his crime.

Judgement on his application has been reserved. The SACP will look at judgement after it is delivered and decide on the next step it would take should it be necessary.
