The SACP has received with utter consternation the statement by the National Prosecuting Authority informed by its discussions with our youth wing, the YCL.
Whilst we respect the role of the National Prosecuting Authority, and understand the complexity of this matter, we are however concerned by its refusal to re-investigate this matter.
We disagree with the NPA when it emphasises the fact that there is no new information that warrants a re-investigation. We also do not agree with the argument that because there are people who have been convicted in this regard and therefore re-investigating is unwarranted. It is not so much a question of new information, but old information that we believe was never adequately followed up. The SACP wishes to point out some of the reasons why the assassination of Cde Hani deserves a new
investigation.
*Firstly*, the amnesty application by Clive Derby Lewis and Januz Waluz was rejected by the Truth and Reconciliation Commission for not having spoken the whole truth. We therefore urge the NPA to approach the former TRC investigators, led by Advocate Dumisa Ntsebenza, who had also dealt with this matter. We believe that a number of clues will emerge from that TRC investigation.
*Secondly*, there are a whole host of matters that, in our view, require further investigation. We believe that the circumstances under which the gun that killed Cde Hani reached Clive Derby Lewis needs to be investigated. It is an established fact that that gun was one of the weapons stolen by the Orde Boerevolk from the South African Air Force armoury. *Thirdly*, the gun was first tested in a farm owned by the brother to Janus Waluz.
*Fourthly*, Janus Waluz was a driver of trucks in a company owned by his brother, and were doing extensive trips into the Southern African region. It is a known fact that Waluz’s brother had deep links with the apartheid military establishment.
This whole trail, we believe, is just one of set of matters that require thorough re-investigation, as it is clear that it is not just the only two convicted persons who could have been involved in the plot to assassinate Cde Hani. The SACP remains firmly convinced that there was a broader right wing plot in the assassination of our General Secretary. It is indeed extremely dangerous that the assassination of a high
profile political leader like Chris Hani can just be left at this.
As the SACP we are asking for a reinvestigation not as some kind of vengeance but to ensure that such dastardly acts never ever take place in our country again, and for all concerned, including the family, to be satisfied that all has been done to get to the bottom of the truth. We also believe that this is one of the most serious outstanding political matters in our country, and especially an outstanding matter arising out
of the final TRC report.
We therefore urge the NPA to reconsider its attitude towards this case. A matter of this nature cannot, and should not, be treated in a cavalier manner.
As the SACP we are determined to ensure that we get to the bottom of the circumstances surrounding the assassination of Cde Hani.
